Bakersfield AI provides AI training, consulting, and educational services to businesses in Bakersfield and Kern County, California. Our services include:

• AI strategy consultation sessions

• Custom AI implementation guidance
• Educational resources and prompt libraries
• Ongoing support and follow-up consultations

Eligibility and Account

You must be at least 18 years old and capable of forming a binding contract to use our services. By using our services, you represent and warrant that you meet these requirements.

If you are using our services on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

Booking and Payment Terms

Discovery Calls (Free)

We offer complimentary 15-minute discovery calls to assess fit and answer initial questions. These calls are free of charge and do not obligate you to purchase any services.

Strategy Sessions ($2,000)

Our 90-minute AI Strategy Sessions are available for $2,000. Payment terms:

• Payment is required at the time of booking
• Payment can be made via credit card, ACH transfer, or other agreed-upon methods
• All prices are in US Dollars
• Prices are subject to change with notice

Cancellation and Refund Policy

Money-Back Guarantee: If you are not satisfied with your strategy session, we offer a full refund if requested within 48 hours of the session completion.

Rescheduling: You may reschedule your session up to 24 hours before the scheduled time at no charge. Cancellations or rescheduling requests made less than 24 hours before the session may be subject to a rescheduling fee.

No-Shows: If you fail to attend a scheduled session without prior notice, the session fee is forfeited and no refund will be provided.

Use of Our Website

Permitted Use

You may use our website for lawful purposes only. You agree not to:

• Violate any applicable local, state, national, or international law
• Transmit any material that is defamatory, obscene, or offensive
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our website or servers

Deliverables and Service Expectations

For strategy sessions, we will provide:

• A 90-minute consultation session
• A custom implementation guide delivered within 48 hours of the session
• 10-15 tailored AI prompts for your business
• Access to our industry-specific prompt library
• Full recording of the strategy session
• Two weeks of email support for implementation questions

Results Disclaimer: While we provide expert guidance and recommendations, we cannot guarantee specific business results or time savings. Results will vary based on your implementation efforts, team adoption, and specific business circumstances.

Client Responsibilities

To get the most value from our services, you agree to:

• Complete any pre-work questionnaires honestly and thoroughly
• Attend scheduled sessions on time
• Provide accurate information about your business, team, and workflows
• Actively participate during consultation sessions and ask questions
• Review and implement the recommendations we provide in good faith

Confidentiality and Non-Disclosure

We respect the confidentiality of your business information. Any proprietary or sensitive information you share with us during consultations will be kept confidential and will not be disclosed to third parties, except:

• With your express written consent
• As required by law
• To service providers bound by confidentiality obligations (e.g., our database provider)

We may use anonymized examples and case studies from our work, but will not identify your business without permission.

Limitation of Liability

To the fullest extent permitted by law, Bakersfield AI and its affiliates, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Any damages arising from your use or inability to use our services
• Any damages resulting from reliance on information or recommendations provided

Our total liability to you for any claims arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Third-Party AI Tools: We provide training and guidance on third-party AI tools (such as ChatGPT, Claude, etc.). We are not responsible for the performance, availability, or results generated by these third-party tools.

Indemnification

You agree to indemnify, defend, and hold harmless Bakersfield AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your implementation of our recommendations or use of AI tools

Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms or our services shall be resolved through:

1. Informal Negotiation: We encourage you to contact us first to resolve any disputes informally
2. Mediation: If informal negotiation fails, disputes may be submitted to mediation in Kern County, California
3. Binding Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in Kern County, California

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Termination

We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for conduct that we believe:

• Is harmful to other users or our business
• Violates applicable laws or regulations

Severability
